1.1. This Acceptable Use Policy ("Policy") applies to all access to and use of Vota, the form and survey builder consisting of a web application at vota.dozy.site (the "Service"), operated by David Kelen, an individual established in France, trading under the name "Dozy" ("Operator", "we", "us" or "our").
1.2. This Policy is incorporated into the Vota Terms of Service. Capitalised terms that are not defined here have the meaning given in the Terms of Service. In particular, a "Creator" is a User who builds and manages forms, and a "Respondent" is any person who opens or submits a response to a published form.
1.3. This Policy applies to every part of the Service, including form titles and descriptions, questions, answer options, section and branching configuration, header images, confirmation messages, redirect addresses, the answers submitted in responses, and the purposes for which a form is used.
1.4. A violation of this Policy may result in immediate enforcement action under section 9, at our sole discretion and, where permitted, without notice.
You must not create, publish, or use a form that:
2.1. is unlawful, or that promotes, facilitates, or provides instructions for unlawful activity;
2.2. sexually exploits or endangers a minor in any way, including child sexual abuse material, sexualised depictions of minors, grooming, and solicitation. This is prohibited absolutely, and we report such material and the accounts responsible to the competent authorities, including the National Center for Missing and Exploited Children (NCMEC) or an equivalent body, and preserve related data as required by law;
2.3. is sexual or pornographic, or that solicits sexually explicit material or images from a Respondent;
2.4. harasses, bullies, threatens, intimidates, or stalks any person, or that is designed to collect information in order to do so, or to dox a person by exposing their private, identifying, or sensitive information without a lawful basis and their consent;
2.5. promotes or incites hatred, discrimination, or violence against a person or group on the basis of race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity, or sexual orientation;
2.6. threatens, glorifies, or incites terrorism or violent extremism, or that provides support to a violent extremist organisation;
2.7. is defamatory;
2.8. infringes or misappropriates the intellectual property rights, privacy rights, publicity rights, confidentiality obligations, or contractual rights of any person, including by using a header image or other material you do not have the right to use;
2.9. contains or links to malware, ransomware, spyware, viruses, or other harmful code, or to a phishing page or other content designed to deceive a person into disclosing credentials, payment details, or other sensitive information;
2.10. impersonates a person or organisation, falsely claims affiliation or endorsement, or is otherwise fraudulent, deceptive, or misleading, including a form that mimics the branding or sign in screen of another service in order to capture credentials or data;
2.11. collects personal data unlawfully, including without a valid legal basis, beyond what is necessary for a specified and legitimate purpose, or in breach of a notice or consent requirement that applies to the Creator; or
2.12. is used to conduct a vote, ballot, or election for which applicable law requires a secret ballot, a certified system, voter eligibility verification, or equivalent safeguards. The Service does not provide these and must not be relied on where they are required.
You must not use the Service to:
3.1. send phishing, harvest credentials, or capture payment card or financial account details under false pretences;
3.2. distribute a scam, a deceptive commercial scheme, unsolicited bulk links, or chain content, or to drive traffic to malware or fraud;
3.3. collect, compile, or enrich personal data about people who have not agreed to it, or to contact people for purposes they have not agreed to, including building marketing or contact lists without a lawful basis;
3.4. submit, generate, or procure automated, fake, duplicate, or otherwise fraudulent responses, or otherwise interfere with the integrity of another Creator's responses or results;
3.5. circumvent, or attempt to circumvent, any capacity limit, published form limit, response limit, per Respondent submission limit, suspension, or removal, including by creating or using additional accounts or forms for that purpose;
3.6. interfere with, disrupt, or impose an unreasonable load on the Service or on another person's use of it, including by flooding a form with submissions;
3.7. submit knowingly false or bad faith abuse reports, or misuse the reporting process; or
3.8. use the Service in a manner that violates the Terms of Service, the Vota Privacy Policy, or any applicable law or regulation.
You must not:
4.1. access or attempt to access the Service, or fill or submit a form, by any automated means, including bots, scripts, scrapers, crawlers, or bulk tools, except as expressly permitted by us in writing;
4.2. build or operate any unofficial client, proxy, or alternative interface to the Service;
4.3. probe, scan, or test the vulnerability of the Service or any associated system or network, or breach, disable, or circumvent any security, authentication, rate limiting, or access control measure, without our prior written permission;
4.4. reverse engineer, decompile, disassemble, translate, or otherwise attempt to derive the source code, underlying ideas, or algorithms of any part of the Service, except and only to the extent that this restriction cannot be excluded under applicable law;
4.5. copy, modify, create derivative works of, distribute, sell, lease, or sublicense any part of the Service;
4.6. introduce any malware or other harmful code into the Service, or use the Service to distribute such code; or
4.7. remove, obscure, or alter any proprietary notice in the Service, or the "Powered by Vota" attribution shown on a published form.
The Service has no public application programming interface. The absence of a technical block on a given action does not make it permitted.
5.1. The Service does not restrict, by plan or otherwise, the questions a Creator may add to a form. You are responsible for what you ask for.
5.2. If you use a form to collect special categories of personal data (data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and genetic data, biometric data used to identify a person, data concerning health, and data concerning a person's sex life or sexual orientation), or to collect government identification numbers, full payment card or financial account numbers, or precise geolocation, you represent and warrant that:
(a) you have a valid legal basis for the collection and, where the law requires it, the explicit consent of the Respondent or another lawful condition for processing that category;
(b) the collection is necessary and proportionate to a specified, explicit, and legitimate purpose;
(c) you provide the Respondent, before or at the point of collection, with all information the law requires; and
(d) you apply any additional safeguards the law requires for that category of data.
5.3. You must not collect this data casually, out of curiosity, or without the safeguards above. We may unpublish or remove a form that appears to solicit this data without an evident lawful basis, and we may require you to demonstrate compliance.
6.1. Content that sexually exploits or endangers a minor is prohibited absolutely and is handled as described in section 2.2.
6.2. A Respondent must be at least 13 years old to submit a response.
6.3. You must not create or publish a form that is directed to children under 13, or that you know or should know will primarily be answered by children under 13, unless you have obtained verifiable parental consent for each such child and you comply with all laws that apply to collecting personal data from children, including the United States Children's Online Privacy Protection Act (COPPA) and equivalent rules in other jurisdictions. The Service does not provide a parental consent mechanism, and you are solely responsible for obtaining and recording that consent.
7.1. You are responsible for the content of your forms, for the data you request, and for the collection, storage, use, disclosure, and deletion of the responses you receive.
7.2. In respect of the personal data in your responses, you are the controller and the Operator is your processor, as set out in section 9 of the Terms of Service. You must have a valid legal basis for the processing, must give Respondents any notice and obtain any consent that the law requires, and must handle Respondents' requests to exercise their data protection rights.
7.3. You must not configure or operate a form in a way that is designed to facilitate conduct prohibited by this Policy, and you must not use the confirmation message or redirect address to send a Respondent to content that would violate this Policy.
7.4. If we introduce a feature that lets a form be embedded on another website, you are responsible for the page on which you embed the form and for any additional notice that page requires.
8.1. To report a form or use of the Service that violates this Policy, contact privacy@dozy.site with the form's link and a description of the issue.
8.2. To report content that sexually exploits or endangers a minor, contact privacy@dozy.site without delay. Do not download, copy, or forward such material.
8.3. We may review forms, responses, and account activity to assess compliance with this Policy. We are not obliged to monitor the Service and do not undertake to review all content.
9.1. If we determine, at our sole discretion, that you have violated this Policy, we may take any action we consider appropriate, including:
(a) issuing a warning;
(b) unpublishing a form, or stopping it accepting responses;
(c) removing, restricting, or editing access to a form or to responses;
(d) limiting features available to you, including creating, publishing, and receiving responses;
(e) suspending or terminating your access to the Service; and
(f) reporting activity to law enforcement or other competent authorities and preserving related data.
9.2. We may take these actions immediately and without prior notice. Where applicable consumer protection law requires notice, reasons, or a cure period, we will comply with that law to the extent required.
9.3. Enforcement action under this Policy does not entitle you to any refund. Matters relating to Plan payments and refunds are governed by the Dozy Terms of Service.
We may amend this Policy from time to time. The current version is identified by the effective date at the top. If we make a material change, we will provide notice through the Service or by email before it takes effect, except where an immediate change is required to comply with law or to address a security or safety risk. Your continued use of the Service after a change takes effect constitutes acceptance of the amended Policy.
